These terms apply when you book an accessibility review with us. They are for businesses, not consumers. When you accept a quote, you accept these terms. If the quote and these terms say different things, the quote wins.

1. Who we are

In The Clear is run by a sole trader registered in Serbia. In these terms, "we" and "us" means In The Clear, and "you" means the business that accepts our quote.

4. How we test

We combine automated tools with hands-on checks using keyboards, screen readers, zoom and mobile devices. Some of the software we use is AI-based. It helps us scan pages, sort results and draft text. We review what goes into the report. Automated and AI-based tools can miss issues or report issues that are not there, which is why we check their results. This does not change what is said in section 3: a review cannot find every issue.

If we do not get these in time, we may need to move the delivery date. We will tell you as soon as we see that.

6. Your permission to test

By accepting the quote, you confirm that you own or control the websites in scope, or have permission from whoever does, and that we may test them as described in the quote. If a site is hosted or run by someone else, such as a platform or agency, it is up to you to arrange their permission.

Our testing is like normal use by a visitor. We do not do security testing, load testing or anything meant to break the site. We do not place real orders or make real payments unless you ask us to in writing.

11. Confidentiality

We keep everything we learn about your business during a review confidential. This includes your report, test accounts, staging sites and anything that is not public. We only share it with service providers we need to do the work, under the same duty of confidence. We do not name you as a client without your written permission.

This does not apply to information that is already public, that we already had, or that the law requires us to disclose. The duty continues after the review ends.

12. Personal data we see while testing

Our review is about how your site works, not about the people who use it. Still, while testing we may see personal data on your site, for example in a test account, a customer review or a staging copy. For that data, you are the controller and we are your processor under the GDPR. We will:

We are based in Serbia, which is outside the EU. Where the GDPR requires it, the European Commission's standard contractual clauses for transfers from a controller to a processor (Module Two) apply between you and us and form part of these terms. If you want a signed copy with the details filled in, ask us.

13. Liability

14. Events outside our control

We are not responsible for delays caused by events outside our reasonable control. Examples are illness, power or internet outages, a failure of a service we depend on, or your site being unavailable. We will tell you as soon as we can and agree a new date with you. If the delay lasts more than 30 days, either of us may cancel, and you pay only for work already done.
